One example of the exception of the URLTA is that it does not specify if it is required of the landlords to keep the security deposit separate from other finances, if the interest is paid, or whether the deposit funds are placed in interest-bearing accounts.
On the contrary, the landlord is required to return part or the total security deposit within 30 days of the termination of the agreement. The landlord may have the right to withhold the tenant’s security money on the charges that include:
Damages other than the normal wear and tear
Unpaid rent
Any breach of the agreement
However, the landlord must provide the tenant with a list describing the damages caused and the amount of the deposit owned when the landlord withholds the security deposit. The itemized list is to be sent to the last known address of the tenant in such events.
Consequences to URLTA
State laws provide guidelines for the termination of an agreement between the landlord and a tenant. The landlord is required to submit a notice to the tenant for its first offense, which may include any violation of the lease or an action that affects the health or safety of the person or the premise. Upon the repeated act of offense by the tenant, the landlord can provide him an unconditional quit notice that provides the tenant with 14 days’ notice to vacate the premises. Only after the two warning notices can the landlord file for an eviction.
On the contrary, if the landlord fails to provide the essentials mentioned under the URLTA, the tenant can present a notice to the landlord specifying the failure or violation and choose the following course of action:
The tenant can arrange for himself with the essential service and deduct the cost from the rent to be paid.
Recover the damages caused due to the non-availability of the essential service based on the reduced value of the rental unit.
The tenant can also choose to shift temporarily to another premise until the landlord provides the essential substance. However, in this option, the tenant is not required to pay the rent until the service is provided.
